These Terms & Conditions ("Terms") govern your access to and use of the website agksfoundation.com and any donation or service offered on it (collectively, the "Platform"), operated by AGKSFOUNDATION, a charitable trust registered in India ("we", "us", "our"). By accessing the Platform or making a donation, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About AGKSFOUNDATION
AGKSFOUNDATION is a not-for-profit organisation registered under Indian charity laws, holding valid registrations under Section 12AB and Section 80G of the Income-Tax Act, 1961, and CSR-1 under the Companies Act, 2013. All funds raised are applied strictly for the charitable objectives set out in our trust deed.
2. Eligibility
You must be at least 18 years old and legally competent to enter into a contract under the Indian Contract Act, 1872 to donate or transact on the Platform. If you donate on behalf of an organisation, you represent that you are duly authorised to do so.
3. Donations
- All donations are voluntary and non-refundable except as permitted by our Refund Policy.
- Donations are accepted in Indian Rupees (INR) through Razorpay using UPI, cards, net-banking or wallets.
- You are responsible for providing accurate PAN and contact details so we can issue a valid 80G receipt.
- Tax benefits under Section 80G are subject to prevailing income-tax rules and your personal tax situation.
- We reserve the right to decline or refund a donation if we suspect fraud, money laundering, or a violation of applicable law.
4. Payment Processing
Payments are processed by Razorpay Software Private Limited, a PCI-DSS compliant payment gateway. AGKSFOUNDATION does not store card numbers, CVV or banking credentials. Your use of Razorpay's services is also subject to Razorpay's own terms.
5. Receipts
A digital 80G donation receipt bearing a unique receipt number is issued after successful payment. The receipt is available on the thank-you page and is emailed to the address you provided. Please retain it for tax purposes.
6. Use of the Platform
You agree not to:
- Use the Platform for any unlawful, fraudulent or malicious purpose.
- Impersonate any person, misrepresent your identity or provide false information.
- Attempt to gain unauthorised access to the Platform, its servers, databases or accounts.
- Introduce viruses, malware or any code intended to damage the Platform.
- Reverse-engineer, scrape, copy or exploit the Platform or its content for commercial gain.
7. Intellectual Property
All content on the Platform — including text, graphics, logos, images, photographs, videos, design, code, and the AGKSFOUNDATION name and marks — is the property of AGKSFOUNDATION or its licensors and is protected by Indian and international copyright and trademark laws. You may not reproduce or redistribute this content without our prior written permission.
8. Third-Party Links
The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices or accuracy of those websites. Accessing them is at your own risk.
9. Disclaimers
The Platform is provided on an "as-is" and "as-available" basis. We do not warrant that the Platform will be uninterrupted, error-free or free of viruses. Programmatic descriptions and impact figures are illustrative and depend on real-world field conditions.
10. Limitation of Liability
To the maximum extent permitted by law, AGKSFOUNDATION, its trustees, employees and volunteers shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the Platform, except in cases of gross negligence or wilful misconduct. Our aggregate liability shall not exceed the amount of your most recent donation.
11. Indemnity
You agree to indemnify and hold AGKSFOUNDATION harmless against any claim, loss, liability or expense arising from your breach of these Terms or your misuse of the Platform.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
